After winning $1billion Apple went to pursue permanent ban on Samsung in US, but Judge Lucy Koh declined Apple’s attempt to ban Samsung’s products in United States saying that Apple hasn’t produced enough evidence and shown ‘irreparable harm’ to legally support such a ban.
Apple had tried to convince the court that iPhone patents were exclusive, but it had in past licensed these to other companies (recently to HTC).
“Weighing all of the factors, the Court concludes that the principles of equity do not support the issuance of an injunction here,” the judge said in her ruling. “The fact that Apple may have lost customers and downstream sales to Samsung is not enough to justify an injunction.
Apple and Samsung have been involved with numerous legal battles all over the world with various results. It seems to me that competing in the market would be a better use of time for both companies.
